The safety and wellbeing of children and young people is the highest priority at MrBurkesClassroom. We are committed to safeguarding and promoting the welfare of every learner who engages with our online tuition services. All children, regardless of age, gender, ability, race, religion, sexual orientation, or background, have the right to learn in a safe and secure environment where their welfare is protected.
This policy sets out how MrBurkesClassroom fulfils its safeguarding responsibilities in line with statutory guidance, including:
- Children Act (1989 and 2004)
- Education Act (2002)
- Keeping Children Safe in Education (KCSIE, 2023)
- Working Together to Safeguard Children (2023)
- The Prevent Duty (2015)
- Data Protection Act (2018) and GDPR
This policy applies to all tuition delivered by MrBurkesClassroom. All lessons are provided online via Google Meet, and resources are shared and stored on Google Classroom. Communication with students takes place only through these approved platforms.
This policy covers:
- Students under the age of 18 enrolled in tuition.
- Adult learners (where safeguarding concerns may relate to vulnerable adults).
- All parents and guardians who engage our services.
The Designated Safeguarding Lead (DSL) for MrBurkesClassroom is Marcus Burke, who is also the company director and lead tutor. As the DSL, Marcus is responsible for:
- Acting as the first point of contact for all safeguarding concerns.
- Ensuring that concerns are recorded, monitored, and, where appropriate, referred to statutory services.
- Liaising with parents, carers, and external agencies as necessary.
- Maintaining up-to-date safeguarding training and awareness of current legislation.
At MrBurkesClassroom we believe:
- Safeguarding is everyone’s responsibility.
- The welfare of the child is paramount.
- All students have the right to protection from abuse and exploitation.
- Children should feel safe, valued, and respected during lessons.
- Concerns must be taken seriously, acted upon promptly, and handled sensitively.
We recognise the four main categories of abuse:
- Physical abuse
- Emotional abuse
- Sexual abuse
- Neglect
We also recognise risks specific to online learning:
- Cyberbullying
- Grooming or online exploitation
- Exposure to inappropriate or harmful material
- Radicalisation and extremism
Because MrBurkesClassroom operates entirely online, the following measures are in place:
- All lessons are delivered via Google Meet with prior parental consent.
- Students access resources through Google Classroom; private contact details are not exchanged.
- Tutors do not communicate with students via personal email, phone numbers, or social media.
- Where possible, students should learn in a location where parents or carers are nearby.
- Lessons may be recorded for safeguarding purposes, with parental consent, and recordings are stored securely.
- Tutors present themselves in a professional environment with an appropriate background.
Staff at MrBurkesClassroom (currently the DSL) are trained to recognise indicators of abuse or neglect, such as:
- Sudden changes in a child’s behaviour, mood, or engagement.
- Reluctance to participate or signs of fear.
- Disclosures of being harmed or unsafe.
- Inappropriate or concerning communication during online sessions.
Procedure for Responding to a Concern
If a safeguarding concern arises during a lesson or through communication with a student:
- Recognition – The DSL will recognise the concern, whether from something observed, something disclosed by the child, or information from a parent.
- Recording – A written record will be made immediately, noting the time, date, what was said or observed, and any action taken. Only factual information will be recorded.
- Referral – If a child is believed to be at immediate risk of significant harm, emergency services (999) will be contacted. For non-urgent but serious concerns, the DSL will make a referral to the local authority Children’s Social Care in the area where the child resides. If the concern relates to radicalisation, Prevent partners will be contacted.
- Informing parents – Parents or guardians will normally be informed of concerns, unless doing so would place the child at further risk of harm.
- Follow-up – The DSL will monitor the situation, maintain contact with relevant agencies, and ensure appropriate records are kept.
If an allegation of abuse is made against Marcus Burke (DSL and lead tutor), the matter will be referred directly to the Local Authority Designated Officer (LADO) where the child lives. MrBurkesClassroom will cooperate fully with any investigation.
During this process:
- Tuition for the student involved will be paused until the allegation is resolved.
- Records of the allegation will be stored securely in accordance with GDPR.
- The priority will remain the safety and wellbeing of the child.
Although MrBurkesClassroom currently operates with Marcus Burke as the sole tutor, any additional staff or contractors in future will be subject to robust safer recruitment, including:
- Enhanced DBS check (with barred list check where appropriate).
- Verification of identity and qualifications.
- At least two references, including the most recent employer.
- Completion of safeguarding induction and training before working with students.
- Safeguarding records are kept separately from academic records.
- All safeguarding documentation is stored securely and access is limited to the DSL.
- Records will be kept for a minimum of six years after a student leaves.
- Information will be shared only when necessary for safeguarding purposes, in line with GDPR.
The DSL will complete safeguarding training at least every two years and maintain awareness of statutory changes through ongoing professional development.
This policy will be reviewed annually, or sooner if there are significant changes to legislation, statutory guidance, or the operations of MrBurkesClassroom.

Code of Conduct for Students & Parents
At MrBurkesClassroom, we are committed to providing a safe, respectful, and productive learning environment for all students. This Code of Conduct sets out the expectations for both students and parents/guardians during online tuition. By enrolling, you agree to follow these standards.
To ensure a positive and focused learning experience, students must:
- Arrive on time for each lesson, with all required materials ready.
- Join from a quiet environment free from distractions (TV, music, background conversations).
- Keep their camera on during lessons unless otherwise agreed for safeguarding or accessibility reasons.
- Engage actively by contributing to discussions, completing tasks, and attempting homework.
- Show respect to the tutor and fellow students at all times.
- Use appropriate language and behaviour when communicating online.
- Stay focused on learning — mobile phones, gaming, or social media should not interfere with lessons.
Parents and guardians play a key role in supporting the success of their child’s learning. We ask that you:
- Ensure your child is ready and on time for each session.
- Provide a suitable workspace that is quiet and safe.
- Encourage homework completion and regular revision.
- Support positive behaviour by reinforcing expectations at home.
- Communicate promptly with MrBurkesClassroom about absences, concerns, or technical issues.
- Respect safeguarding boundaries — all communication with the tutor should go through official channels (email, WhatsApp, or Google Classroom).
If expectations are not met, the following steps will be taken:
- Reminder – The student will be reminded of the expectation.
- Warning – A clear warning will be given if behaviour does not improve.
- Temporary removal – The student may be placed in the online waiting room or muted.
- Parental contact – Parents/guardians will be informed of repeated or serious behaviour issues.
- Withdrawal of place – In extreme or persistent cases, MrBurkesClassroom reserves the right to withdraw the student’s place. Refunds will not be issued for missed sessions due to misconduct.
In order to maintain professional boundaries and a safe learning environment:
- Failure to respect communication boundaries, repeated late payments, or behaviour that undermines learning may result in tuition being suspended or terminated.
- Refunds will not be issued in cases where lessons are missed due to parent non-cooperation or repeated disruption.
- Students must only communicate with tutors through approved channels (Google Meet, Google Classroom, or parent-monitored WhatsApp/email).
- Parents are encouraged to be within proximity of the lesson, though not actively participating unless agreed.
- Any safeguarding concerns will be dealt with in line with the MrBurkesClassroom Safeguarding & Child Protection Policy.
By enrolling with MrBurkesClassroom, both students and parents/guardians agree to:
- Follow this Code of Conduct.
- Support the learning environment by ensuring expectations are met.
- Acknowledge that failure to adhere to this code may result in consequences as outlined above.

Exclusion, Removal, and Suspension Policy
At MrBurkesClassroom, every student has the right to learn in a safe, respectful, and productive environment. While we work hard to support all learners with empathy and patience, there are circumstances where behaviour, repeated disruption, or failure to meet expectations may lead to temporary suspension or permanent removal from lessons.
This policy explains the stages and procedures that will be followed if such action is required.
A student may be suspended or removed for reasons including (but not limited to):
- Persistent disruption of lessons or refusal to engage with learning.
- Repeated failure to meet behaviour expectations outlined in the Code of Conduct.
- Use of abusive, threatening, or discriminatory language or behaviour towards the tutor or other students.
- Inappropriate use of technology during lessons (e.g. misuse of chat, gaming, or accessing inappropriate material).
- Failure by parents/guardians to support expectations (e.g. repeated lateness, lack of payment, ignoring communication).
- Safeguarding concerns where continued attendance would place the student or others at risk.
Our approach is progressive, giving students and parents opportunities to improve before formal action is taken.
Stage 1: Informal Reminder
- The student will be reminded of the expected behaviour or standard.
- Parents/guardians may be notified if the issue is recurring.
Stage 2: Formal Warning
- A clear warning will be issued, outlining the concern and the improvement required.
- A written note/email may be sent to parents to ensure clarity.
Stage 3: Temporary Suspension
- If behaviour does not improve, the student may be suspended from one or more lessons.
- The duration of the suspension will depend on the circumstances.
- Parents will be contacted directly with an explanation and next steps.
Stage 4: Final Review Meeting
- A discussion will be arranged between the parent/guardian and MrBurkesClassroom.
- Together, we will decide whether the student can return under a behaviour agreement, or whether removal is necessary.
Stage 5: Permanent Removal/Exclusion
- If issues continue despite previous interventions, MrBurkesClassroom reserves the right to permanently withdraw the student’s place.
- In cases of serious misconduct (e.g. aggression, safeguarding concerns), removal may occur immediately without going through all prior stages.
Parents/guardians are expected to:
- Reinforce behaviour expectations at home.
- Ensure their child attends lessons on time and is prepared to learn.
- Communicate respectfully and promptly with MrBurkesClassroom.
- Cooperate with any improvement plans agreed during review meetings.
Failure to support these responsibilities may result in suspension or removal of the student’s place.
MrBurkesClassroom reserves the right to:
- Suspend or remove any student whose behaviour disrupts the learning of others.
- Terminate tuition where safeguarding concerns arise, or where the parent/guardian relationship breaks down.
- Refuse refunds for sessions missed as a result of misconduct or suspension.
Parents may raise concerns about decisions by contacting MrBurkesClassroom in writing within 7 days of notification. While all appeals will be considered carefully, the final decision rests with MrBurkesClassroom to ensure the safety and wellbeing of all learners.
This policy will be reviewed annually, or sooner if changes in legislation or practice require it.
💷 MrBurkesClassroom Payment & Fees Policy
- All tuition fees are payable monthly in advance. This ensures lesson slots are reserved and resources can be planned effectively.
- Invoices are sent on the 24th or 25th of each month for the following month’s lessons. Each invoice will contain a clear breakdown of lesson dates and times agreed for that month.
- Payments are due by the 1st day of the month. For example, invoices sent on 25th September must be paid by 1st October for all October lessons.
- Parents/guardians are expected to make payment within 7 days of receiving the invoice.
Failure to pay on time may result in the suspension of lessons until the balance is cleared.
To provide flexibility, MrBurkesClassroom accepts:
- BACS transfer (preferred method – details are listed on all invoices).
- Visa/Mastercard payments made securely online.
- Klarna instalments – for parents who wish to spread the cost of tuition.
All payments must be made electronically. Cash and cheque payments are not accepted.
- MrBurkesClassroom understands that families may occasionally face genuine financial difficulties. In such cases, parents are expected to contact MrBurkesClassroom immediately to discuss the situation and agree an alternative payment arrangement.
- Where payment has not been made by the due date and no agreement has been reached, lessons will be suspended until payment is received.
- If late or missed payments become a recurring issue, MrBurkesClassroom reserves the right to terminate tuition services permanently.
- Lesson schedules are confirmed in advance of the 1st of each month. Any requests to change days or times must be communicated before the new month begins.
- Once the schedule has been confirmed and invoices issued, full payment for all scheduled lessons is expected, regardless of student attendance.
- Changes requested after the 1st of the month cannot normally be accommodated.
- If a student is unable to attend a lesson due to illness, family emergencies, or other unavoidable reasons, parents must inform MrBurkesClassroom as soon as possible.
- In these cases, a lesson credit will be applied to the following month’s invoice.
- Where absences become frequent or prolonged, a discussion will take place with parents to determine whether tuition can continue. Repeated cancellations may result in the student’s place being withdrawn.
- If MrBurkesClassroom cancels a lesson, parents will be given a choice of either:
- A full refund for the missed lesson, or
- A lesson credit applied to the following month’s invoice.
This ensures parents are never financially disadvantaged by cancellations made by MrBurkesClassroom.
Occasionally, lessons may be disrupted due to technical issues such as internet failure, power cuts, or other unavoidable emergencies. If this happens:
- Where possible, the lesson will continue once the issue has been resolved.
- If the lesson cannot continue, MrBurkesClassroom will:
- Rearrange the remaining lesson time at a mutually convenient day/time, or
- Apply a lesson credit to the following month’s invoice.
Parents will always be informed promptly in such cases.
- Refunds will not normally be issued for lessons missed by students once the month has started, as slots have already been reserved and prepared for.
- Credits will be applied instead in cases of illness or unavoidable absence (see Section 5).
- Refunds may be issued in exceptional circumstances at the sole discretion of MrBurkesClassroom.
MrBurkesClassroom reserves the right to suspend or terminate tuition in cases of:
- Persistent late or non-payment of fees.
- Repeated cancellations or lack of engagement.
- Breaches of the Code of Conduct, Safeguarding Policy, or Exclusion and Suspension Policy.
If tuition is terminated by MrBurkesClassroom, any pre-paid lessons that have not been delivered may be refunded or credited, depending on the circumstances.
While these policies ensure structure and consistency, MrBurkesClassroom recognises that every family’s circumstances are different. We are committed to handling all payment and scheduling matters with understanding and fairness, while also ensuring that lessons remain financially sustainable and beneficial for all students.

At MrBurkesClassroom, we take our responsibility to protect the personal information of students, parents, and guardians extremely seriously. This policy sets out how we collect, use, store, and share personal data in line with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
We recognise that families are trusting us with sensitive information, not only about student performance but also about safeguarding and family circumstances. This trust must be respected at all times. We are committed to:
- Being transparent about how data is collected and used.
- Using data only for legitimate educational and safeguarding purposes.
- Keeping information safe and secure at all times.
- Ensuring families understand their rights under GDPR.
To deliver high-quality tuition and meet our safeguarding duties, we collect different types of information, including:
- Student Information: full name, date of birth, school year, email address, assessment records, progress notes, safeguarding records, homework submissions, and attendance logs.
- Parent/Guardian Information: full name, email address, phone number, billing address (if required), and payment details for invoices.
- Lesson Data: attendance records, notes on participation and progress, and, where consented, audio/video lesson recordings.
- Technical Data: IP addresses, device/browser information, and login activity to Google Meet or Google Classroom, if needed to resolve technical or safeguarding issues.
The information collected is used for the following purposes:
- To deliver lessons and provide access to Google Classroom and Google Meet.
- To monitor student progress, including assessment of strengths and areas for development.
- To communicate with parents about timetables, invoices, progress reports, and safeguarding concerns.
- To maintain accurate safeguarding records, in line with our Safeguarding & Child Protection Policy.
- To issue invoices and process payments securely.
- To ensure compliance with legal and statutory responsibilities, including safeguarding obligations and financial record-keeping.
We will never use personal information for marketing purposes, nor will we sell or share data with third parties for commercial gain.
Under UK GDPR, personal data must only be processed under a lawful basis. At MrBurkesClassroom, data is processed on the following bases:
- Contractual Obligation: information is required to deliver the tuition services parents have booked.
- Legal Obligation: safeguarding children is a statutory duty, which may require us to share data with social services or police if concerns arise.
- Legitimate Interest: to manage lessons effectively, maintain records, and improve tuition delivery.
- Consent: where lesson recordings are made or optional services are provided, explicit parental consent is required. Consent can be withdrawn at any time.
- Lessons may be recorded with prior written consent from parents/guardians.
- Recordings are used strictly for safeguarding, training, or revision purposes.
- All recordings are stored securely and deleted after a set period (normally one academic year).
- Parents and students have the right to withdraw consent at any time.
We use a range of measures to keep data safe:
- All electronic data is stored on password-protected systems and encrypted cloud services.
- Google Meet and Google Classroom are used under Google’s GDPR-compliant educational services.
- Access to sensitive safeguarding data is restricted to Marcus Burke, the Designated Safeguarding Lead.
- Paper records (where necessary) are kept in locked, secure storage.
- Lesson recordings and student records are backed up securely and are never stored on personal devices outside of secure systems.
We will only share personal information with third parties when absolutely necessary, including:
- Safeguarding referrals: to local authority Children’s Social Care, police, or Prevent teams, if required to protect a child.
- Financial purposes: with banks or payment processors when processing invoices.
- Legal obligations: when requested by law enforcement or regulatory bodies.
We will never sell or share personal data with third parties for advertising, marketing, or unrelated commercial purposes.
- Student and safeguarding records will be retained for six years after tuition ends, in line with safeguarding best practice.
- Financial records (e.g. invoices, receipts) will be kept for seven years to comply with tax requirements.
- After the retention period, data will be securely destroyed, either by shredding (for paper records) or secure deletion (for electronic data).
Under UK GDPR, parents and students have the following rights:
- Access: the right to see the personal data we hold about them.
- Correction: the right to request that inaccurate or incomplete information be corrected.
- Erasure: the right to request deletion of data (where lawful and appropriate).
- Restriction of Processing: the right to limit how data is used in certain circumstances.
- Data Portability: the right to request a copy of personal data in a portable format.
- Objection: the right to object to certain forms of data processing.
- Withdrawal of Consent: for optional activities, such as lesson recordings, parents can withdraw consent at any time.
Requests must be made in writing to info@mrburkesclassroom.com. We will respond within 30 days.
MrBurkesClassroom has a duty to protect personal data. In the event of a breach (e.g. accidental loss, unauthorised access, or theft of data):
- Immediate steps will be taken to contain the breach and secure data.
- A full investigation will be carried out, and affected families will be notified without delay.
- Serious breaches will be reported to the Information Commissioner’s Office (ICO) within 72 hours, as required by law.

Complaints Policy

MrBurkesClassroom strives to deliver high-quality tuition and build strong, respectful relationships with all students and families. However, we recognise that sometimes concerns may arise.
This policy sets out the framework for managing complaints in a way that is fair, consistent, and transparent. The aim is always to resolve issues quickly and informally wherever possible. Where formal procedures are required, they will be managed in line with best practice guidance from the Department for Education (DfE) and principles of natural justice — meaning that complaints will be listened to fully, considered objectively, and handled without bias.
This policy applies to:
- All parents and guardians who engage tuition services.
- All students enrolled at MrBurkesClassroom.
This policy does not apply to:
- Safeguarding or child protection concerns (these follow the Safeguarding & Child Protection Policy and will be referred directly to statutory agencies).
- Complaints about third-party services outside of MrBurkesClassroom’s control (e.g. internet failures at the student’s home).
- Complaints will be dealt with seriously, respectfully, and confidentially.
- The complainant will be given the opportunity to explain their concerns in full.
- MrBurkesClassroom will seek to resolve concerns at the earliest possible stage.
- No student will ever be penalised or disadvantaged as a result of a parent making a complaint.
- Because MrBurkesClassroom is directed by a sole tutor, an independent person may be engaged to review and investigate formal complaints to ensure objectivity.
Stage 1: Informal Resolution
- Parents/guardians are encouraged to raise concerns informally, either via email, WhatsApp, or scheduled call with Marcus Burke.
- Most concerns can be resolved at this stage through open discussion, clarification, and minor adjustments.
- A record of the concern will be logged for monitoring purposes.
Stage 2: Formal Written Complaint
- If a matter cannot be resolved informally, parents/guardians may submit a formal written complaint to info@mrburkesclassroom.com.
- The complaint should clearly outline: the issue, relevant dates, and what resolution is being sought.
- Receipt of the complaint will be acknowledged within 5 working days.
- Because MrBurkesClassroom is a sole-provider service, if the issue involves Marcus Burke directly, an independent investigator (for example, a trusted professional from the education sector or safeguarding network) will be appointed to review the complaint. This ensures the process remains impartial.
- A full investigation will take place, involving review of lesson records, communication logs, and any relevant evidence.
- A written response will be provided within 15 working days of acknowledgment. This will include findings, actions taken, and next steps.
Stage 3: Review
- If the complainant is dissatisfied with the Stage 2 outcome, they may request a final review.
- A review meeting will be offered (online), attended by Marcus Burke and, where necessary, the independent reviewer.
- The aim is to give all parties the chance to clarify outstanding issues and agree a resolution.
- A final written decision will be provided within 10 working days of the review meeting. This decision will be considered final.
Possible outcomes of a complaint may include:
- An explanation or clarification of the situation.
- An apology where appropriate.
- Adjustments to lesson arrangements or timetables.
- A written agreement to avoid similar issues in the future.
- A partial or full refund, if deemed fair.
- Confirmation that no further action is required.
While MrBurkesClassroom is committed to resolving genuine concerns, complaints that are repetitive, unfounded, aggressive, or unreasonable may not be pursued indefinitely. In such cases, MrBurkesClassroom reserves the right to:
- Limit further correspondence.
- Provide a final written response and close the matter.
- Terminate tuition services with appropriate notice if the parent–tutor relationship has broken down.
- All complaints will be handled with discretion.
- Records will be kept securely in line with the Data Protection & Privacy Policy.
- Complaint outcomes will not be shared beyond those directly involved, except where required by law or safeguarding duties.
Complaints are monitored regularly to identify recurring issues and improve services. An annual review of complaints will inform updates to this policy.
MrBurkesClassroom is committed to a culture of openness and accountability. Complaints will always be taken seriously, investigated thoroughly, and resolved in a manner that is fair, proportionate, and consistent with best practice.

Online Safety & Digital Use Policy

MrBurkesClassroom is an online tutoring platform. All lessons take place virtually via Google Meet, with resources and homework set through Google Classroom. Because our teaching is exclusively online, it is vital to have strong measures in place to protect students from digital risks and to ensure lessons remain safe, respectful, and professional.
This policy sets out expectations for safe online behaviour and outlines the procedures in place to protect both students and the tutor. It should be read alongside the Safeguarding & Child Protection Policy and the Code of Conduct.
- To safeguard students from inappropriate online risks while learning.
- To set clear expectations for students and parents during online lessons.
- To ensure that communication between tutor and student is professional at all times.
- To explain the procedures in place for dealing with online safety concerns.
MrBurkesClassroom acknowledges the following online risks:
- Cyberbullying – students being teased, excluded, or targeted online.
- Grooming or exploitation – attempts by individuals to exploit children through digital platforms.
- Exposure to harmful or inappropriate material – including violent or sexual content.
- Privacy breaches – misuse of student data, lesson recordings, or personal contact details.
- Digital wellbeing – overuse of screens, fatigue, or lack of safe study space.
To reduce risks, the following safeguards are in place:
- All lessons are conducted through Google Meet, accessed via official links only.
- Students must join lessons using their real name for safeguarding purposes.
- Lessons may be recorded with parental consent for safeguarding, revision, or training purposes.
- Tutors will never use personal email, phone, or social media accounts to contact students. All communication must go through Google Classroom or the parent’s chosen contact channel (email/WhatsApp).
- Students are expected to join from a quiet, safe, and appropriate environment. Bedrooms with closed doors are discouraged unless a parent is nearby.
- Students must keep their camera switched on during lessons unless agreed in advance (e.g. SEND or accessibility reasons).
- Join lessons on time with materials ready.
- Keep language, behaviour, and body language respectful at all times.
- Use technology responsibly — no gaming, social media, or browsing during lessons.
- Only use the chat function for lesson-related communication.
- Do not share lesson links or Google Classroom access with anyone else.
- Do not attempt to record or screenshot lessons without permission.
- Ensure your child is in a suitable learning environment (quiet, safe, with minimal distractions).
- Ensure your child is ready and logged in on time.
- Supervise younger students where appropriate, and be available nearby in case of issues.
- Communicate promptly with MrBurkesClassroom if technical problems or safeguarding concerns arise.
- Respect professional boundaries — contact the tutor through approved channels (not personal accounts).
- Personal data is handled in line with the Data Protection & Privacy Policy.
- Lesson recordings are only made with consent, stored securely, and deleted after the retention period.
- Student work is stored in Google Classroom, which is GDPR-compliant.
- Access to safeguarding and academic records is restricted to Marcus Burke (DSL).
If an online safety concern arises during a lesson:
- The student may be muted, removed to the waiting room, or the lesson ended early if necessary to protect others.
- A written record will be made of the incident.
- Parents will be informed as soon as possible.
- Serious concerns (e.g. cyberbullying, harmful content, safeguarding disclosures) will be handled according to the Safeguarding & Child Protection Policy and may involve statutory agencies.
Failure to follow this policy may result in:
- A verbal reminder or warning.
- Temporary removal from a lesson.
- Parental contact and formal warning.
- Suspension or removal from MrBurkesClassroom (see Exclusion & Suspension Policy).
